1. Acceptance of Terms

By downloading, installing, or using Dusky, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the service.

2. Description of Service

Dusky is an AI-powered assistant that provides real-time contextual suggestions during conversations. The service captures audio and screen content from your device, processes it through third-party AI providers, and displays AI-generated information to assist you.

3. User Responsibility

You are solely and entirely responsible for your use of Dusky.

3.1 Compliance with External Policies

You are responsible for understanding and complying with any rules, policies, codes of conduct, or agreements that govern your interviews, meetings, workplace, or conversations. This includes but is not limited to:

• Employer policies on recording or AI assistance
• Interview guidelines and integrity policies
• Professional licensing requirements
• Contractual obligations
• Academic integrity policies

Dusky makes no representation about whether its use is permitted in any particular context. That determination is yours alone.

3.2 Disclosure

You are solely responsible for deciding whether and how to disclose your use of Dusky to others. We provide no guidance or recommendation on disclosure.

3.3 Verification of AI Output

All content generated by Dusky is produced by artificial intelligence. AI-generated content may be:

• Factually incorrect
• Outdated or incomplete
• Contextually inappropriate
• Technically inaccurate
• Plausible-sounding but wrong

You must independently verify all AI-generated suggestions before relying on them. You are responsible for any decisions you make based on AI output.

3.4 Consequences

You accept full responsibility for all consequences arising from your use of Dusky, including but not limited to:

• Interview outcomes (positive or negative)
• Employment decisions
• Professional reputation
• Relationship impacts
• Legal or regulatory consequences
• Academic consequences

4. No Guarantees

Dusky provides no guarantees whatsoever regarding:

• Accuracy, completeness, or reliability of AI-generated content
• Interview success, job offers, or favorable outcomes
• Continuous, uninterrupted, or error-free operation
• Compatibility with your specific use case
• Compliance with any third-party policies or requirements

5. Acceptable Use

You agree to use Dusky only for lawful purposes and in accordance with these Terms.

You agree NOT to:

• Use Dusky in violation of any applicable law, regulation, or third-party policy
• Use Dusky to engage in fraud, deception, or misrepresentation that causes harm
• Attempt to circumvent any security features or access controls
• Reverse engineer, decompile, or disassemble the software
• Redistribute, sublicense, or resell Dusky or access to it
• Share your account credentials with others or allow multiple users to access a single account
• Use automated tools, bots, or scripts to interact with Dusky
• Use Dusky for any purpose other than personal, individual use

6. AI-Generated Content Disclaimer

All suggestions, answers, summaries, and other content generated by Dusky are produced by third-party AI systems. Dusky is a conduit for AI processing, not the source of intelligence.

You acknowledge and agree that:

• AI systems have inherent limitations and can produce errors
• AI output should never be treated as authoritative or verified
• You bear sole responsibility for how you use AI-generated content
• Dusky has no control over the accuracy of AI provider outputs

7. Third-Party Services

Dusky relies on third-party services to function, including AI providers (Anthropic, OpenAI, Google), transcription services (AssemblyAI), and infrastructure providers (Supabase). Your use of Dusky is also subject to the terms and policies of these providers.

We are not responsible for the actions, policies, or service quality of third-party providers.

8. Account and API Keys

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• The security and proper use of any API keys you provide
• Any charges incurred through your API key usage

9. Intellectual Property

Dusky software and its original content are owned by the service operator and protected by applicable intellectual property laws.

You retain ownership of your own content. AI-generated suggestions are provided for your personal use only.

10. Subscription and Payment

If you purchase a paid plan:

• You agree to pay all fees associated with your purchase
• All sales are final; no refunds are provided
• Monthly subscription holders may cancel anytime; cancellation takes effect at the end of the billing period
• Time-limited passes (Weekly, Job Hunt) expire at the end of their stated duration
• We may change pricing with 30 days notice

You agree to indemnify, defend, and hold harmless Dusky and its creator, affiliates, officers, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of any third-party rights, policies, or agreements
• Your violation of any applicable law or regulation
• Any content you submit or transmit through the service

14. Termination

• You may stop using Dusky and delete your account at any time
• We may suspend or terminate your access immediately, without notice, for any violation of these Terms
• We may discontinue the service at any time with reasonable notice
• Upon termination, your right to use Dusky ceases immediately
• Sections 3, 6, 11, 12, and 13 survive termination

15. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes through the application or by email. Your continued use of Dusky after such notice constitutes acceptance of the modified Terms.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of Dusky shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in class actions.

17. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

18. Entire Agreement

These Terms constitute the entire agreement between you and Dusky regarding the service and supersede all prior agreements.
